1. About These Terms

Welcome to My Keepsake. These Terms of Service govern your access to and use of mykeepsake.store, including purchases made through our online store.

The words “we,” “us” and “our” refer to:

Our store is powered by Shopify, which provides the technical e-commerce platform. All contracts for the purchase of products from this store are concluded directly between you and My Keepsake, not Shopify.

By using our website or placing an order, you agree to these Terms. If you do not agree, you should not use the website or place an order.

Nothing in these Terms excludes or limits any mandatory consumer rights available to you under applicable law.

2. Eligibility and Customer Accounts

You must have the legal capacity required under the law applicable to you to enter into a purchase contract.

If you create a customer account, you must provide accurate and current information and keep your login details confidential. You are responsible for activity carried out through your account unless it results from circumstances outside your control.

Please contact us promptly if you believe that your account has been accessed without authorisation.

We may suspend or restrict an account where reasonably necessary to protect the customer, our store or other users, or where these Terms or applicable law have been violated.

3. Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, sizes, colours, materials, prices and availability are accurate.

The appearance of colours may vary slightly depending on your screen, device and display settings. Such minor display variations do not affect your statutory rights if a product is materially different from its description.

Product images may include mock-ups or lifestyle photographs. The product description and selected options form part of the contract.

Measurements may vary within reasonable manufacturing tolerances stated on the product page or size guide.

We may update, modify or discontinue products and designs at any time before an order is accepted.

4. Orders and Formation of the Contract

Products displayed in our store constitute an invitation to place an order.

By submitting an order, you make a binding offer to purchase the selected products. Before submitting the order, you can review and correct the products, quantities, delivery details and other entered information.

After you place an order, we will send an automatic acknowledgement. This acknowledgement confirms that we received your order but does not necessarily mean that the order has been accepted.

The purchase contract is concluded when we confirm acceptance of the order or begin fulfilment, whichever occurs first.

We may decline or cancel an order for a legitimate reason, including:

• the product is unavailable;
• payment cannot be authorised;
• the delivery address cannot be serviced;
• the order information appears materially incorrect;
• we reasonably suspect fraud or unauthorised activity;
• an obvious pricing or product-information error occurred; or
• fulfilling the order would violate applicable law.

If we cancel an order after receiving payment, we will refund the amount paid without undue delay.

5. Prices, Taxes and Payment

Prices are displayed in the currency selected for your market.

Before you submit an order, the checkout will display the total price payable, including the product price, applicable taxes and any delivery or other mandatory charges known to us.

Where applicable taxes or charges depend on your delivery location, they will be calculated and displayed during checkout before you confirm the order.

For deliveries outside the territory in which taxes are collected at checkout, the destination country may impose import duties, customs charges or local taxes. Where such charges are not included in the checkout total, they are normally collected by the relevant authority or carrier and are the customer’s responsibility, provided that this information was disclosed before purchase.

Available payment methods are displayed during checkout. Payment is processed securely by the applicable payment provider. We do not store complete payment-card numbers.

You confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate.

6. Production, Shipping and Delivery

Some products are produced after an order is placed. Estimated production and delivery times are displayed on the website, during checkout or in the order confirmation.

Delivery times are estimates unless we have expressly agreed to a guaranteed delivery date. We will deliver the goods without undue delay and, for consumers in the EU or EEA, no later than 30 days after the contract is concluded unless another delivery period has been agreed.

We are not responsible for delays caused by events outside our reasonable control. If a material delay occurs, we will inform you and explain the available options.

For consumer orders, ownership and the risk of loss or damage pass to you when you, or a person designated by you other than the carrier, physically receives the goods.

If you independently appoint a carrier that was not offered by us, risk may pass when the goods are handed to that carrier, to the extent permitted by applicable law.

7. Cancellations, Returns and Right of Withdrawal

Cancellations, returns, exchanges and refunds are governed by our Returns, Refunds & Right of Withdrawal Policy:

Consumers in the EU and EEA generally have the right to withdraw from an online purchase within 14 days after receiving the goods without giving a reason, subject to applicable statutory exceptions.

In addition, My Keepsake offers an eligible voluntary return period of 30 days as described in our Refund Policy.

The statutory right of withdrawal does not generally apply to goods made to the customer’s individual specifications or clearly personalised products. A product is not considered personalised merely because it is produced after ordering when the customer selects from standard products, designs and options offered in our store.

Nothing in this section restricts your rights in relation to defective, damaged, incorrect or non-conforming goods.

8. Conformity and Statutory Guarantee

Products must conform to the contract, their description and the quality that a customer may reasonably expect.

If a product is defective, damaged, incorrect or does not conform to the contract, contact us at info@mykeepsake.store and provide your order number and a description of the issue.

Depending on the circumstances and applicable law, you may be entitled to:

• repair;
• replacement;
• an appropriate price reduction; or
• termination of the contract and a refund.

For consumers in the EU and EEA, goods are covered by the applicable statutory legal guarantee of conformity, which is generally at least two years from delivery. National law may provide additional protection.

These statutory rights are separate from the right to withdraw from an online purchase and cannot be excluded by these Terms.

9. Intellectual Property

The website and its contents, including original designs, illustrations, photographs, text, graphics, logos, videos, product names and the arrangement of the website, are owned by or licensed to My Keepsake and are protected by applicable intellectual-property laws.

You may access and use the website for personal, non-commercial shopping purposes.

Without our prior written permission, you must not:

• reproduce, distribute, sell or commercially exploit our designs or website content;
• remove copyright, trademark or other ownership notices;
• create products or derivative works using our designs;
• scrape or systematically extract website content; or
• use our name, logo or designs in a way that suggests an unauthorised relationship with My Keepsake.

Nothing in these Terms transfers ownership of our intellectual property to you.

Shopify’s name, trademarks and services remain the property of Shopify or its licensors.

10. Acceptable Use

You may use the website only for lawful purposes.

You must not:

• use the website for fraud, unlawful activity or infringement of another person’s rights;
• provide false or misleading information;
• introduce viruses, malware or harmful code;
• interfere with the security or proper operation of the website;
• attempt to gain unauthorised access to accounts, systems or data;
• collect another person’s personal information without authorisation;
• send spam or unsolicited communications through the website;
• misuse customer reviews or impersonate another person; or
• use automated tools to overload, disrupt or circumvent reasonable technical restrictions on the website.

We may take reasonable measures to prevent misuse, including restricting access or suspending an account.

11. Reviews and Customer Content

If you submit a review, photograph, comment or other content, you confirm that:

• you have the right to submit it;
• it is accurate and not misleading;
• it does not infringe another person’s rights;
• any incentive or compensation connected with the review has been disclosed; and
• it does not contain unlawful, abusive or harmful material.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use the submitted content for operating and promoting My Keepsake.

You retain ownership of your content. We may remove content where reasonably necessary because it violates these Terms, applicable law or the rights of another person.

12. Third-Party Services and Links

The website may contain links to or integrations with third-party services, including payment, social-media and delivery providers.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control.

This does not limit our responsibility for service providers acting on our behalf or any responsibility that cannot be excluded under applicable law.

13. Relationship With Shopify

My Keepsake is powered by Shopify, which provides the e-commerce platform used to operate the store.

Purchases made through our store are made directly from My Keepsake. Shopify is not the seller of our products and is not responsible for fulfilling orders, accepting returns or handling product claims.

Shopify may process personal information in connection with the operation and improvement of its services as explained in our Privacy Policy and Shopify’s Consumer Privacy Policy.

15. Website Availability and Errors

We aim to keep the website accurate, secure and available, but we cannot guarantee uninterrupted or error-free access at all times.

We may temporarily restrict access for maintenance, security, technical problems or circumstances outside our reasonable control.

We may correct obvious typographical, technical, pricing or availability errors. If an error affects an order already placed, we will contact you and provide an appropriate solution, which may include giving you the option to confirm the corrected order or receive a refund.

We will not cancel a consumer order solely because correcting an error would be commercially inconvenient.

16. Liability

Nothing in these Terms excludes or limits liability:

• for death or personal injury caused by negligence;
• for fraud or fraudulent misrepresentation;
• for intentional misconduct or gross negligence;
• for defective products where liability cannot legally be excluded;
• for breach of mandatory consumer rights; or
• where exclusion or limitation is otherwise prohibited by law.

Subject to the above, we are not responsible for loss caused by events outside our reasonable control or for loss that was not reasonably foreseeable when the contract was concluded.

If you are a consumer, we are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for business losses suffered by a consumer where the products were purchased primarily for personal or household use.

17. Governing Law and Jurisdiction

These Terms and contracts concluded through our store are governed by the laws of the Czech Republic.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of habitual residence.

Nothing in these Terms restricts your right to bring proceedings before a court that has jurisdiction under applicable consumer-protection law.

18. Complaints and Alternative Dispute Resolution

If you have a complaint, contact us first at info@mykeepsake.store. We will attempt to resolve the matter directly and without undue delay.

Consumers may also use an applicable out-of-court dispute-resolution body.

19. Changes to These Terms

We may update these Terms to reflect changes in our services, business practices or legal obligations.

The current version will be published on this page with the updated date. Where required by law, we will provide notice of material changes.

Changes do not retroactively alter contracts already concluded unless required by law or expressly agreed with the customer.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, it will be limited or removed only to the minimum extent necessary. The remaining provisions will continue to apply.
